Poltergeists these days come through social media, offering multiple spinning wheels, promising to turn the straw of engagement and trust, into the gold of long lasting revenues.

For mediation professionals, trust is the only currency worth having, whether at the table with conflicting parties, or blogging about strategies and approaches to conflicts.

Trust goes directly to relationship in the overall mediation process as well and the revenue generated from that trust should appear as referrals on the trusted mediator’s bottom line.

Or, mediators can just wait on Rumplestiltskin to show up…

[Strategy] “Yes We Can!”

Boy, isn’t that a catchy phrase.

The word “we” is synonymous with enabling others to act, but there are a couple of other pieces that go along with that word:

  • There are two kinds of power—Many leaders resort to “power over,” when they lose faith or trust (more on this in a minute) in their followers to accomplish the goals that leaders have articulated. Leaders with bad visions (i.e. Hitler, Stalin, etc.) do this more often than leaders with good visions (i.e. Steve Jobs, Moses, etc.). But “we” creates the second kind of power, “power with.” It empowers followers to see the vision and implement it in their own way.
  • Trust is always an issue—When leaders “let go” and truly begin trusting “the masses” to move a vision forward, some followers aren’t going to get the message right. Some followers are going to be deceitful and self-serving. And some followers are going to fall away when it gets to be too hard. Martin Luther King, and Gandhi both experienced this, but it did not diminish their faith and trust in their followers.
  • Carrying capacity increases—A leader who doesn’t have to control the “scope creep” of a spreading vision, is not really a leader. Part of acting on a vision is that when action starts, so do reactions: from friends, enemies, circumstances and opportunities. How does a leader know when to say “yes” and know when to say “no”? Well, when the number of followers increases because of trust and empowerment, then the ability to say “No, I can’t right now…but give it to Sally over there” becomes a statement of collaboration, rather than a principled rejection.

We without empowerment, trust and collaboration is just a word with smoke but no fire and followers can easily become cynical when its overuse transforms from inspiration to cliché.

“Yes we can!”

Trust Me

“Trust me. I got this.”

If there is any other phrase that precedes a sense of oncoming dread and mistrust, it’s this one.

If there is a statement that preceded eventual conflict more than any other, we aren’t aware of it.

Trust, when freely given, often operates as a noun, describing a person, place, thing or an animal.  In such a context, trust transforms a relationship from one level and moves it into a far more intimate level.

However, in the above statement, trust transforms from a noun to a verb, requiring the giver to transform into a passive actor in their own drama. In such a context, trust transfers control from an active actor, engaged with their own outcomes, to another active actor whose motives may not be—well—trustworthy.

The sender of the phrase is looking to reassure the receiver and, typically, this sentence means that the reassurance is not working.

The professional peacebuilder should probably avoid the transformation of trust from an active noun to a passive verb, unless the relationship that she is building is long-term enough to warrant such a change.

Otherwise, she’s just asking for trouble.

The Shifting Social Contract

Privacy, the law and the social contract is breaking down.

People want to access the internet and be social privately, secretly and anonymously, but the NSA reads our emails and may soon have access to the data that all the devices in our home will be sharing with each other.

The Lockian social contract is breaking down with technology that Locke could never have anticipated, in an effort to create a Rousseauian-libertine future with no responsibility for what we say and do.

And that’s at a macro level.

Then there is bullying and social break down in social media. Children push each other to suicide. People are redefining the workplace and griping about it on social media. People are making individual economic choices at a rational (and emotional) level to pick streaming over subscription packages.

And that’s at the micro level

So…what does all of this have to do with mediators and conflict?

At the intersection of macro and micro concerns regarding privacy, trust, secrecy, confidentiality and the breakdown of the general social contract, lies a place for peacemakers with skills and talents to train, advise, coach and mentor those for whom active listening, empathy and civil liberties seem to be quaint holdovers from an era of powdered wigs and wine snobs.

How to Solve the National Deficit

The national deficit is a problem.

 It erodes faith in institutions that should be acting in good faith to bind us together. 

The deficit creates artificial conflicts with real consequences, and separation with real differences. 

The deficit decreases national, regional and local credibility of elected, appointed and promoted leaders and serves to further deepen the chasm between those who are clever enough to pay attention to the game from those who still watch American Idol. 

Some people opine that “We’ve always had this deficit,” or “It’s always been this way,” but that doesn’t mean that we shouldn’t take the necessary hard steps to reduce our deficit. 

Some of those steps require hard self-analysis and the courage to tear down old, institutional structures and to erect new ones. 

The national trust deficit is a huge problem.

On Insurgency

On this day, in 1776 an insurgency began.

Think about it:

Tweet: The world’s largest empire at the time was categorically rejected by a country with almost no standing military,no domestic governmental structure and no hope of ever defeating the much larger empire.

The insurgency was formulated by men who had multiple goals and motivations (as do all men, at all times) but the ultimate mission of all of their goals was the establishing of a country founded in a set of principles.

The insurgency took over 200 years to become established as apple pie, Mom and, well…the flag.

Makes you wonder where all of the modern insurgencies going on now will end up in 200 years.

[Opinion] Would You Like a Side of Mediation with That?

Mediation and sales have several things in common:

  • They both involve establishing trust right away.
  • They both involve starting from a referral from one or more of the parties.
  • They both involve establishing a relationship between the two parties and the mediator/s.

The key place where sales and mediation differ is that a sale is usually closed: Either the salesperson gets the order and gets paid, or the prospect gets the salesperson to go away.

Mediation relies on both parties having the autonomy to walk away. Sales involves parties being pressured (whether lightly or heavily) into making a decision to “buy” or “walk-away.”

The big takeaway form all of this is that if your career is in mediation, learning where to put pressure on versus where to ensure autonomy will ensure that each participant has a satisfactory outcome.

And that you get paid.

Active listening is a huge driver for both sales and mediation.

If you aren’t listing to what your customer is saying that they want—or the parties in the dispute are saying that they want—you’ll wind up going home.

Rousing Action


What is the difference between cooperating on a project and collaborating on an initiative?
Over the last two weeks, we’ve covered the first two legs of the abundance economy, built online, and of the future, for the purposes of understanding what our leverage points will be to accomplish entrepreneurial goals.
The first two legs of the stool are trustand generosity.  The third is collaboration.
Cooperation is working together to accomplish the same goal.
Collaboration is the act of working with someone to produce or create something.
Collaboration and cooperation are synonyms in the dictionary. However, in reality one is a passive act and the other is an active act. 
Both require teamwork in order to accomplish a goal and in a generous economy, based in an ethic of abundance; but, one asks of people to make a decision and to get involved.

The other asks people to come along for the ride.

Both require a certain value set.
But when one is active, versus one being passive, how do you choose which content to use to rouse your audience to action?

Santa’s Accountability Problem

Trust during the holiday season is freely given. It must be something about the charitable feeling and spirit around the  month between the day after Thanksgiving and the day after Christmas.

Whatever the psychological, theological or emotional motive this feeling of trust  springs from, the public is sure to hear stories in the news about organizations (the Salvation Army), corporations (any retail giant) and governments (yes, I’m looking at YOU Healthcare.gov) abusing this trust for nefarious means.

It kind of puts in perspective what was said here and here this week; but bear our indulgence on this point for just a moment:

Trust requires that the giver and the receiver engage in a dance of vulnerability and responsibility.

The giver must be willing to put down cynicism and suspicion and the receiver must be accountable and responsible.

The charities and organizations that are doing best—both now and in previous holiday seasons—are those that focus on the intersection between quality, accountability, transparency and relationship.

When trust happens between the giver and the receiver, a relationship is built up over time that neutralizes deceit, suspicion, obfuscation and irresponsibility.

And that’s a process that’s even more scalable than the industrial based processes that got us to where we are now.

Remember, it took us 100 years to get to this point…it will take at least that long to get us back to sanity.

A Suggested Donation

Placing trust and value in a process that is not fee based—instead is given away for free, a low cost or for a “suggested donation”—is the future in an abundant, connection based economy where, ultimately at the end of the day, everyone will be giving something away for nothing.

“Well, you know, we got what we paid for,” is the common lament expressed by many who have participated in a free process.
The two most common questions that people have who have little trust in a free, abundance based process are:

  • “When are you going to take all of this stuff that you are doing for free and make some money off of it?”
  • “When are you going to stop putting out ‘junk content’ and monetize it?”

The questions tend to come from individuals, corporations, organizations and others who are so wedded to the industrial based past, that they cannot understand that “free” creates an abundant, connection based future.
The reverse of these two questions are the ones that many (who are also wedded to the industrial based past) ask who are at the provider end, offering a service for “free” or in exchange for a “suggested donation.”

  • “Why can’t we get people to pay us to do this (insert name of humanitarian service here)?

Scarcity in an abundance economy is built around the cornerstone of trust: If payment is coming for something that is offered initially for free, then trust must be established and maintained that what is being paid for has even greater value than what was just received for free. 
Or, I have to trust that the organization or person requesting a “suggested donation” for a service that they just provided for free, will give me back something with even better consistency and quality.
Either way, the hard work for the provider, shifts from asking for a fee and hoping that one will come while toiling under budget constraints and doing mediocre, rote work, to instead providing the service for free and then creating a relationship with the end-user based on the idea that something else more awesome lies just behind the pay wall.
The newspaper business couldn’t figure this one out. 
Neither could the music industry. 
Both have collapsed.
And more collapses are coming, from the way cars are sold to the way that the United Way raises money.
