[Strategy] On Truth and Reconciliation

There’s truth.

There’s reconciliation.

Rarely do you get both of them together.

This isn’t to say that parties seeking reconciliation are engaging in deceitful behavior or lying to gain an outcome that benefits them in a conflict process. But we are all selfish and no more so than when we can see the light at the end of the tunnel of conflict.

This isn’t also to say that parties seeking truth are engaging in behavior that will prolong conflicts and make them worse. But we are all myopic when our needs aren’t met around core values—like getting to the truth of a matter.

Just because you get the truth from the other party in conflict about their motives, their moods, their inner drives, or the outcomes they want, doesn’t mean that you’re going to get reconciliation.

And just like resolution, reconciliation may just be as hard to arrive at.

[Opinion] It’s Up to MBAs to Save the World

Business students—modern day, Internet savvy, native users of the information superhighway we’ve all built for the last twenty or so years—can save the corporate world.

The unfortunate thing is that somewhere along the way to cashing out in a cushy consulting position, or advancing in organizations by whose culture they are troubled, someone forgot to tell them.

This is not unusual. Partially it’s due to the echo chamber of higher education—the faculty who teach from a worldview and frame set on preserving the world they teach in—and partially it’s due to a corporate world still focused (in spite of all the evidence of disruption to the contrary) on achieving cookie-cutter, command-and-control outcomes on a quarterly basis.

There are, of course, a range of types and varieties of business students, from undergraduate business majors, dutifully studying their work at second, third, and fourth tier institutions, all the way to community and junior college students “older-than-average” who return to business programs to either run a small business better, or to provide for their families.

Finally, there are the top tier, classic business school students from elite institutions who are studying to become the next masters of the universe. These are the ones that we traditionally think of as dominating the salaries and cultures of corporations and organizations where MBAs are hired.

Except, at all levels, the work that matters is shifting away from what a human used to do well toward what a computer can do better. Accounting, spreadsheet analysis, financial reporting, supply chain management, and on and on, really matter less and less as topical areas of focus and interest in a world where information is changing hands faster than the left to right swiping motion on a smartphone screen.

The work that does matter, in organizations, to individuals, and the work that is going to reshape the global paradigm of the next fifty years, doesn’t show up on spreadsheet, and can’t be open to analysis. And it never did; but, industrialists of the past century who built the old paradigm want MBAs and anyone in a business program of any kind to continue to believe otherwise.

Philosophically, there must be a change in how we teach bright, young, ambitious, people at all levels (from community college programs to the Ivy League) in order to succeed with outcomes that will be measurable, not in terms of dollars and cents (though that will come) but in terms of people, connection, and the continuing malleability of human nature.

But what would a two-year immersive, MBA experience look like?

Here’s a rough idea of how practically, an MBA program would look, one focused on getting bright, ambitious, Internet native, students to develop and nurture the kind of work that will grow organizations in the 21st century:

      • People Management
      • Psychology of Supervision
      • Storytelling
      • Listening

  • Year Two:
    • Semester One:
      • Finance
      • Accounting
      • Supply Chain Management
      • Quantitative and Qualitative Analysis
    • Semester Two:
      • Persuasive Writing
      • Digital/Virtual Leadership
      • Organizational Culture
      • Restorative Justice
  • Capstone Project: Go and Turn Your Peer-Reviewed Project from the 1st Semester into a Business

And after all of this, there must be follow-up. But not in the traditional sense of “Did you get a job?” and “How much does it pay?” which are questions that really only interest the federal student loan originators. Instead, follow-up with these students would be focused on the only metrics that matter: failure, success, long-term growth, and connection:

  • Did you fail in 5 to 7 years after the program?
  • Did you succeed in 5 to 7 years after the program?
  • What “dent” if any, did you make in the universe?

And that’s it.

With such a program, the MBAs we are turning out from all institutions would be prepared to save the world from the current troubles and hypocrisies, that have caused many corporations to collapse under the inability to change for the future that is here.

Now.

[Strategy] Reframing your Organization’s Litigation Strategy

Your organization’s litigation strategy is based on how your organization perceives giving an apology, taking responsibility, or passing around blame.

Your organization’s litigation strategy is based on how the founder perceives conflict, engagement, resolution, and even resilience and grit.

Your organization’s litigation strategy is based on how founders, executives, investors, employees, clients, customers, and others integrate and engage with (or don’t) lawyers, the legal system, and even legal professionals.

Your organization’s litigation strategy is not an accident, or something that “just grew” like Topsy. It is a strategy that is either intentional, or reactive.

Just like your organization’s conflict engagement, avoidance, or resolution strategy.

[Strategy] My Mind is Made Up

“My mind is made up.”

Well…ok then.

Your mindset, your framing of the world and the way that it’s ‘supposed’ to work, your story that you tell yourself about your conflicts, disputes, and differences of opinion, can be changed.

Unlike in the old Ten Commandments movie from back in the day, your ideas and stories developed over time. They weren’t etched irrevocably in granite tablets and then thrust upon you.

Though sometimes it may feel like that.

At least once (or maybe twice) in every training opportunity, there comes a moment to challenge a frame or a mindset, or a story, about how something ‘should’ or ‘ought’ to work. And at that moment, the phrase “your frame—your worldview—got here before the facilitator did” pops out of the trainer’s mouth.

But even this statement betrays a mindset, a story, a frame of references around the malleability of these frames, and the biological ability for a person to change their, already made up, minds.

The ability to shift frames, and to change them based on the persuasion of new knowledge, is not a sign of a lack of consistency—the crowd (e.g. other people) makes sure that you are remain consistent, even unto rhetorical death—instead, it is a sign that the window dressing of our frames, stories, and mindsets, can be changed and are flexible.

Mediation, conflict resolution, conflict coaching, conflict engagement, negotiation: all of these processes exist to persuade you that your mind can be changed; and in some cases, to persuade you that changing your mind may lead to more positive outcomes than the ones that you have been experiencing all this time.

But sometimes, people don’t want different outcomes.

Sometimes, parties in conflict get unnerved by participating what they perceive as processes that involve too much “second guessing” and “over thinking.”

Sometimes parties in conflict want affirmations, reassurances, and confirmation that their story is the right one and the only one with any validity in the marketplace of ideas.

So when one party’s mind is “made up” the question becomes: As the party on the opposite side of the table, are you ready, willing, and able to engage in the hard emotional labor of changing that other party’s mind?

Or is your mind now made up as well?

[Strategy] Failure is an Option

Resolution is a loaded word.

Typically, we want conflicts, disagreements, “differences of opinion,” and other ways that we frame the dialogue of conflict, to work out in ways that work for us.

Ways that allow us to accomplish our goals in the most expedient manner possible, and the other party—well they can worry about themselves.

In this context, resolution becomes a chimera, something wildly implausible (according to our narrow definition of what is plausible) and that we chase without really planning on catching.

In this context, resolution must take on a new meaning, focused on cessation of conflict, moving toward peace, and engaging to get to reconciliation.

In this context, failure becomes an option, when it is failure to get resolution in the face of success at gaining other outcomes that might be more important to the parties involved.

Strategically allow failure to occur in the process of getting to resolution, has to be a tactical choice, rather than a passive act (or at worse, a default position of manipulation to attempt to ensure future success) because it involves leveraging the trust and faith of both parties in the process of resolution, rather than in each other.

And when the process gets to be more important than the parties, resolution becomes easier to attain rather than harder.

[Advice] Hold Onto Your Heart

In any conflict, the hardest thing to do is to hold onto your heart.

When people mediate conflicts, whether professionally or informally, they run the risk of being demoralized by seeing the behavior of participants in the conflict.

Have you ever heard the joke about the family and divorce mediator who mediated their own divorce after doing this work for many years?

It’s not a good joke.

Hold onto your heart. Hold onto your vulnerability. Hold onto your tenderness. Hold onto your openness.

It’s too easy to let go when everyone around you is letting go as well.

[Advice] Blogging for the Peace Builder

Blogging is still the easiest, lowest cost, way to build a business, establish a client base, become an influencer, or just to use a voice that matters.

It’s almost free marketing that is always on, always distributed, and always accessible.

There are great ADR professionals such as Cinnie Noble, Tammy Lenski, Victoria Pynchon and a few other high profile ADR practitioners, capitalizing on their blogging efforts. But for many ADR professionals, other than the contributors at Mediate.com (and here at ADRTimes.com), blogging is still viewed as a “one-off, one-time” thing.

There are many objections to blogging from the peace builder, but three are primary:

  • I don’t have time to blog.
  • I don’t know what to blog about.
  • I’m not a writer.

Let’s break those down:

I don’t have time to blog:  ADR professionals lead busy lives. They mediate, negotiate and arbitrate complex issues that place psychological and emotional strain on them. Then, they return to homes where they may be confronted by more conflict (Ever hear the joke about the mediator who mediated their own divorce proceeding? I have. It’s depressing.) And, peace building professionals are exposed to more conflicts in social media feeds and from popular culture.

Then, there are children, partners, and responsibilities. By the time the end of the day comes, they are ready to do what their clients do: Go to bed and go to sleep. Then they get up and repeat it.

Who has time to blog?

Well, I’m writing this article in between just having fed my four-year old daughter and working on a client project. What I have found is that there are spaces in the day where thoughts worth blogging about can come flooding in. And, when we sit down at our seats in front of the computer, time becomes available, in spite of distractions, children, clients and other responsibilities.

I don’t know what to blog about: There is so much conflict in the world, at both an organizational and individual level, that I am often surprised by how many peace builders believe this. Peace builders witness disputes in line at their favorite coffee shop in the morning. Disputes occur at local school board meetings, attended the night before. There are disputes in our social media feeds, or even in the newspaper.

When I started blogging regularly, I worried about filling digital space with something meaningful. Then I had a revelation: The number of people consuming content in a digital space will always outweigh the number of people creating content in digital space.

The other piece to consider in this, is a thought that many peace builders have that goes “I don’t have anything to say (or write) so what could I possibly write about?” The fact of the matter is, we need more people who are involved in building peace to have the courage to lay out an argument, stake a claim to a position of truth, and then defend it vigorously and assertively. Courage has always been in short supply in the digital space (see the proliferation of Buzzfeed-like listicles and “Top 25” posts) and hiding away from the consequences of taking a position on topics such as neutrality, client-self-determination, or even the area of deep listening, does not negate the overwhelming need for online wisdom. The fact of the matter is, wisdom is also in short supply in a world where every piece of knowledge is a Google search away. We need more peace builder’s wisdom in the online space and the best place to get that wisdom across is through online, long-form, writing.

I’m not a writer: Many people stop writing regularly about the same time they put college (or high school) in the rearview mirror. Writing is hard, but for the peace builder, writing is the best way to explore and develop thoughts about process, procedure and practice and to grow the field. We need more writing, not less.

And, putting together a sentence or two is really all that it takes to begin. Once that happens, the real struggle becomes how to improve writing, rather than how to start.

One last point on all of this: Many peace builders want to begin writing, but fear that when they are vulnerable in the online space; when they take a position, raise their hand and say “this is me, this is what I’m making,” that there will be pushback from trolls, baiters, scammers, critics, and other bad actors (or actors with mixed motives) online. The thing to remember is that, at a practical level, the bad actors, spammers, and trolls are merely seeking negative attention and—even more perniciously—are seeking to place their shame on the person taking a stand.

At a practical level, the way around this for the peace builder to not accept comments on their blog. Or, to moderate them, or even to not read them. But, peace builders should never allow the bad actor to steal their voice, out of their own mouth, before it has even been used.

[Opinion] On Winning at Nuclear Poker

Nuclear weapons are a touchy subject in geopolitical negotiations.

Almost everyone involved in the negotiations around nuclear weapons knows what the outcomes of launching them against another country could be, which is why, following the collapse of the former Soviet Union, regionalism in arms races became a geopolitical concern.

But in reality, the issue with nuclear weapons is not really the weapons themselves. In reality, the issues around negotiating with developers of nuclear weapons is the attitudes, motivations, and psychological desires of the people who run the governments that are either developing nuclear weapons (North Korea, Iran, etc.) or who already have them (Russia, the US, China, etc.)

This is similar to negotiations that go on around issues that are less geopolitical and more commonplace. When you are negotiating with your wife about where to go to dinner, her mindset, attitude, body language, motivations, and your previous history with her, matter more to the outcome of that negotiation, than where you eat.

In our individual and corporate lives there are many nuclear weapons that we hide inside of our interactions. Some of them take years to build and only a minute to deploy and to wreck destruction.

We often don’t talk about our tendency to build up resentment, unforgiveness, anger, bitterness, and hatreds, until they are primed and ready to launch. Exploding on another party. Usually, not the party that we want to have them explode upon.

That person (a parent, a child, a former spouse, a family member, a neighbor, a politician) is usually either too far away emotionally, or too distant physically, for us to actually launch our carefully curated and developed personal stockpile of nukes upon them.

Mob behavior, direct democracy, these are both example of personal nuclear behavior writ large, at scale, and just as destructive as at the personal level.  Nuclear poker is played at this level as well: by politicians, pundits, professional prognosticators and others. But here’s the thing, from the geopolitical level all the way to your individual level of your individual world:

  1. Nobody knows how anybody else is going to respond to a nuclear strike—either personal or global.
  2. The appearance of being crazy, or dysfunctional, enough to destroy everything can sometimes act as a deterrent to people actually going ahead and pushing the button to destroy everything—either personally or globally.

The personal (and global) question in any negotiation where the threat of nuclear destruction is on the table, is: How crazy do you want to be to ‘win’ at nuclear poker?

[Opinion] The Self-Deception Game

There will always be the option to drink your own Kool-Aid.

There will always be the option to continue believing that “everything will just ‘work out’ somehow.”

There will always be the option to avoid doing the hard work of being uncomfortable while learning a new competency (consciously unskilled) and to just continue reacting to conflicts in ways that have always worked for you.

There will always be the option to continue to be self-deceived into believing that when disagreements, disputes, and fights arise that the best way to react is the way that you’ve always reacted.

There will always be the option to continue to be surprised, follow directions, avoid responsibility, never challenge the status quo, and to continue to avoid absorbing new information.

There will always be the option to disengage, or even worse, to engage selectively with people, situations, and messages that you “like” and that are comfortable for you to understand, accept, and integrate into your worldview—because they already confirm your worldview.

The systems of communication, and the economies of scale growing inside of them, that we are building and the new ways of connecting, are not going to grant outsized rewards to worldviews that are willing to choose among the above options.

In fact, the worldviews that those options represent will continually be exposed to the antiseptic sunlight of other views, shining through the new communication systems that we are constructing.

My grandmother used to say “Truth crushed to earth will rise again.” But there will always be the option to construct your own truth—no matter your worldview—in the face of challenging conflict—and hope that it all works out.

[Advice] Relational Resonance

Resonance is a term from physics that describes what happens when an object’s natural vibration frequency responds to an external stimulus of the same frequency.

Resonance occurs in nature when an object vibrates without you even touching it. Resonance happens when people fall in love with each other; and, resonance shifts when people fall into conflict with each other.

The reason that litigation is such a poor method for resolving disputes is because most—if not all—disagreements, fights, and “differences of opinion,” are about relationships, built on reciprocation and maintained through common resonance. When the frequency gets disrupted by an external change, the resonance goes away and the struggle to resolution really a hero’s journey back to resonance. Litigation changes the frequency of the relationship between individuals and between individuals and organizations, from one of commonality and vibrating at the same frequency, to one of vibrating at different frequencies.

What does all of this have to do with the conflict resolution professional?

  1. Creating stories that resonate with audiences and clients who are seeking to get back into relationships with resonance, is one of the most important skills that peace builders must grasp in order to design, market, and promote products, services, and processes that will get them revenues.
  2. Creating resonances is about getting to the same frequency—at the same time—that audiences and clients are no matter when and where they are in conflict. Thus, peace builders must consider whether advocating for early-stage interventions (rather that primarily trying to promote late-stage resolution products and services) is a better way to proceed long-term.
  3. Creating the conditions for conflict resolution professionals and audiences to speak the same language—and thus be on the same frequency, will require conflict resolution professionals at all levels to abandon the higher language of “conflict as an opportunity for growth” and move toward the audience language of “conflict as a roadblock to be avoided, accommodated, or attacked.”

The first two are easy. The last is hard.

Peace building is about doing the hard things, doing them well, and doing them consistently—and in a committed way—and building a field and a brand over time that audiences will flock too, that clients will gladly pay money for, and that peace builders can hand down to the next generation of professionals.

Relational resonance must move from the table between clients and the peace builder to the platforms between peace builders and the world.
