[Strategy] Burnout Over The Pacific

When you talk with divorce and family lawyers about divorces, separations, or even “conscious uncouplings” a statement they always make in the course of the conversation focuses around their amazement that couple choose to go through a litigation based process.

In particular, their statement tends to focus on the fact that litigation takes time and is more emotionally draining than mediation, and yet many couples would prefer to go through that process than another, more collaborative one.

There are many points to consider from this observation, but there are three immediate ones that could be instructive and strategic for your conflict situation—even if you’re not getting a divorce, experiencing a separation, or have decided to “consciously uncouple”:

  • A desire to see “justice done” is really a desire to see our will done unto the other person who hurt us. Which really means, when we go to a third party (whether a lawyer or a judge—and sometimes even a mediator) we aren’t looking to grow collaboratively with the other party out of a difficult relationship. We’re really looking for revenge and a reckoning.
  • Collaboration is not about “being friends again” or even forgiving the other party. Collaboration is simultaneously a selfish and selfless act of growing with that other person (who sometimes you have a deeply personal relationship with) so that the relationship can end in a way that benefits both of you. Mediation is a collaborative process. Litigation is always a competitive process.
  • Litigating not to “lose” is not the same as not collaborating to “win.” The fact of the matter is, “winning” and “losing” are black and white concepts that have little to nothing to do with the facts of the dispute, the relationships involved, the values on the table, the positions and interests of the parties involved, or the outcome in question. But parties in a dispute often view not “losing” (or outright “winning”) as the only satisfactory strategy that can justify emotional decisions made in all of those areas. Which is why litigated disputes always end up feeling emotionally hollow and are often decided—in hindsight—to have been a waste of both time and energy.

Many people in disputes, conflicts, disagreements, and who are having “differences of opinion” with other parties, experience a sense of burnout throughout the processes of both litigation and mediation. But the question on the table is “Do you prefer your burnout slow and steady, or quick and dirty?”

Answering that question, individually and corporately, with honesty, self-awareness, and insight into the other party, can lead to picking the best process for managing your particular conflict.

[Advice] We Are Surrounded By The Remains Of Average…

Have you looked at a factory building lately?

If you walk around your town (either America or globally) you can see the remains of burned out factory buildings, corporate office complexes, and even industrial parks that lie empty, vandalized, or half occupied by struggling commodity businesses.

If you walk around your town (mostly in America) you can see the remains of a K-12 education system that used to be the model of the world. Inside many school buildings, there remain students that sit in rows, raise their hands obediently, only speak when they are called upon, are taught to pass the test, and when they don’t or can’t perform in those ways, they are labeled and sometimes forgotten.

If you walk around your town (mostly in the formerly Western World) you can see the remains of churches. Sure, the seats are full in some buildings, but increasingly, buildings are emptying and churches are closing. And more and more there is the trumpeting of people who claim irreligiousness (or disbelief) and in response more and more churches are coasting on the past Spirit (both financial and otherwise) that used to there, and hoping that a positive change (that resembles past glories) will come.

What do the physical buildings, the educational system, and the church all have in common in your town? Or mine?

They are the remains of a time when being just average was “ok.” They are the remains of the third greatest revolution in human history, the Industrial Revolution. They are all that remains of a promise that was over engineered, over sold, and over bought: The consumer (or employee) can just show up at work, do average work just a little better year on year, and then retire and be “ok.” In addition, the consumer (or employees) children will be educated to a standard that will be just a little better each year, and the family will get a little safer each year, in a neighborhood that will be a little better each year, and everything will be “ok.” And, of course, the church will require just a little more (usually money) from the consumer every year, and this will be “ok.”

We are surrounded by the remains of “ok” in a time when “ok” is no longer good enough. And when the disconnect between “ok” and reality reaches a breaking point, we get demagogues, marketers, con men, flim-flam men, and others selling us a bill of goods about a return to a glorious past, rather than the hard truth about the realistic future:

Here’s the hard truth:

“Ok” was never good enough. And doing “just a little better” than last year isn’t going to get the same outcome financially, morally, ethically, or materially anymore–if it ever really did in the first place. The greatest psychological block of our time for people to overcome (at least in America) is this idea that average work, average effort, and average outcomes are still “ok”—even as everything we see economically, spiritually, and materially at the start of the fourth greatest worldwide revolution proves otherwise.

From our physical infrastructure to our internal responses to conflicts, meaning, and mattering, we’ve got to stop walking around our towns (either physically or metaphorically) trying to recapture “ok” and instead shift to inspiring people at every level to consistently pursue better than “ok” to get to best.

[Advice] The Law of Average

It used to be ok to be, well, “ok.”

It used to be “ok” to do good enough work at home with your kids, in the neighborhood with your community, and in your church with your time.

It used to be “ok” to just show up, do what you’re told, don’t ask too many questions, and be the nail that hammered itself down.

It used to be “ok” to not do the little extras, to not give a little more, to care only at the level you were comfortable caring at and to devote little or no time to thinking about why that was ok.

And in this time, when things used to be “ok,” political world leaders still were elected and assassinated with regularity, wars still were started and ended, products were still invented and sold, television programs, the newspapers, and other forms of communication tools still worked to get you information. And people still lived and died, marketing still worked, and scandals still intrigued the masses.

So what happened?

The Law of Averages says that in a sample of any kind, from neighborhoods, to marketing campaigns, the statistical distribution of outcomes among members of a small sample must reflect the distribution of outcomes across the population as a whole.

The law has always been a fallacy, based on observed, personalized experiences that are then transposed to a much larger (or sometimes different) population sample. And the rules that the industrialists, the marketers, the politicians, and the policy makers created in the 20th century (and that they are mightily trying to recreate in the 21st century) are responsible for the massive belief in the law of averages.

But, wishful thinking is not reality. And the reality is, it was never good enough to just be “ok”: whether at your job, at communicating in conflict situations, or at creating a project, or taking a risk. And now, because of technological shifts that have been long remarked upon and analyzed, the fallacy is being exposed at mass, for what it is.

It’s not good enough to be average at communicating in a conflict scenario.

It’s not good enough to just show up at home, at church, in your community, or at work.

It’s not good enough to not go the extra mile, do the extra thing, and take the extra time, even if you don’t get paid for it. Especially if you don’t get paid for it.

It’s not good enough to disengage from what’s going on in someone else’s political, economic, spiritual, or financial reality because “that doesn’t impact me over here.”

Wishful thinking that “it will all be ‘ok’” doesn’t work anymore (and never really did), because it won’t be “ok.” The cultural, social, political, and financial machine that used to guarantee that “ok” would be good enough, is breaking down.

Its only individuals (not the masses at scale) who can choose to do the hard work that moves humanity collectively from merely “ok” in our emotional, spiritual, and material interactions with each other, and moves us to better, and finally to best (or most remarkable) in the world: meaning the world individuals inhabit on a daily, weekly, yearly basis, not the whole wide world.

Navigating the tension between the desire to passively slip into the anonymity of “ok” and the need to actively move from “ok” to better to best, is the place where engagement—personal and meaningful—must happen in the 21st century if humanity is to become the best version of humanity it can be.

[Opinion] Edges of the Universe

There is the edge and the long tail.

From the work of Chris Anderson, the idea of the long tail is that the world of “hits” (television shows, Top 40 music, etc.) is gone and the world of “niches” (Twitter users, YouTube video consumers, etc.) is here and is growing exponentially, year-on-year, as the cost of creating, developing, or doing, in general, drops to almost $0.

For peace builders looking to make money, get attention, gain credibility, or grow a practice, the “hits” are jobs in academia, working with NGO’s, or becoming lawyers who do peace building (i.e. mediation, negotiation, arbitration) on the side. The “niches” are where I am with this blog, launching a new podcast, or even trying to leap into live video streaming of mediation, negotiation, or arbitration sessions.

So why are peace builders chasing the chunky head (“hits), rather than heading out on the exponentially longer long tail (“niches”)?

There are two answers to this question:

The long tail is a lonely place. Peace builders by nature, temperament, and training are communal people, longing to connect clients with solutions and to resolve sticky problems. It’s lonely to go out to the long tail, because professional colleagues may tell you that you’re “wrong” in your approach. Or they may not let you into the world of conferences, associations, membership groups, or other places where business gets transacted. And when you’re a peace builder looking for work that matters, it’s easier to struggle to get into the chunky head and make noise there, than to take a professional risk to venture out on the long tail.

The edges of peace building are about the unknowable and unpredictable. Resolution is the reduction, or elimination, of tension between people. Engagement is about seeking out the tension, appreciating it, and not seeking to resolve it. At the edges of peace building lie technologies and technological developments, that have made the world of communication outside of peace building more striated, more differentiated (thus the long tail) and more separated. The tension has increased with social media saturation, 24/7/365 marketing messaging, and people increasingly choosing to opt-out rather than to opt-in. These changes are creating an atmosphere that is ripe for peace builders of all backgrounds to step in and show the way to reduce tension—or at the minimum get parties to engage with it in healthier ways—using stories that resonate with the language people in conflict at the edges are using right now.

Doing work at the edges that matters, requires going to the spot on the long-tail that matches your temperament as a peace builder and then to mine that spot ruthlessly. It also requires making peace with the tension of the unpredictable, and the unknowable.

But peace builders ask their clients to do this all the time, from the mediation table to the negotiation table.

[Opinion] The Good News

The set-up for the story is always the same.

There’s coercion, envy, false accusations, an artificially whipped up mob, a person turned into a scapegoat and a trial without representation, on trumped up charges, geared toward a predetermined outcome.

Then there’s an execution by a regime a downhill slide from a once great republic, with once great ideals, that has become inherently monarchal, brutal, and undemocratic.

There are manipulations, machinations, and deceitful dealings by people who care more about power and religion than relationship with the people they are claiming to serve.

And then, at the end of twelve hours, it’s supposed to be all over.

But then, a radical claim that’s never again been claimed by anyone else since that time in the history of the world, is made three days later. The scapegoat is said to be alive, walking around, not seeking vengeance, or destroying those who destroyed Him. Instead, He’s talking about peace, forgiveness, and preparing His bewildered and scared followers for even greater things to come.

And then, body and all, He disappears; leaving behind a world filled with followers, disbelievers, empires ruled by men who seek power and recognition above all else, and leaders who seek power and religion more than relationship.

Jesus Christ’s death and resurrection is the most powerful story told in human history.

There are many reasons for its power, but at the bottom of it, is the radical idea that a man can be killed for saying all the things out loud that people think in their hearts about how the world—and our relationships should be—and then can be filled again with new life, and then leave the Earth, body and soul, of His own volition.

This is a story that many, many people reject. This is a story that many, many people find too unbelievable to be believed. This is a story that many, many people have argued with, fought against, or sought to co-opt for centuries.

But it’s a story that won’t go away.

And today, on Good Friday in the Christian world, Believers in the power and message behind, underneath, and through that story, would do well to take some time to meditate on what that story really means around their worldview, their decisions, and their lives.

I know that I will.

[Strategy] My 6 Biggest Mistakes…pt.2

I had turned back to the computer and was working again, when the ramifications of the first three of my six biggest mistakes came down upon me like a whirlwind.

Or, at least that’s what it felt like.

They came in a group (my Grandmother and my martial arts instructor years ago used to warn me that was how they always come at you) and they were angry. They started yelling at me across the lobby of the big building, and fortunately, since it was late at night, I didn’t attempt to meet them halfway, to exit the safety of the desk area, or to engage them in any way. I watched them walk over quickly, not quite understanding what I was about to experience.

That was my fourth mistake.

I stood up and took a power stance. I spread my legs (they could only see me from the waist up) and crossed my arms as they approached. Then I heard the yelling:

“Why did you come inside and talk to us that way!?”

“What were you talking about in there!?”

“There were other people in that room making noise hours ago and you didn’t come in then!!!”

I started to respond—not thinking at all—as they approached, yelling. Then, both they and I realized something at the same time: We (the two men and the two women and I) both shared the same skin color. I was dressed in the assigned outfit from the company though. And they were dressed—well—however…

“I can only address what I’m actually told about,” I said as they approached. “I was told a few minutes ago that there was a disturbance going on in the room, and the person wanted me to address it. The person also indicated that you were in the general area and had been making noise all night.”

By this time, the inside of my head felt like it was on fire. I was watching their body language, trying to determine if they  were going to really be a REAL problem (i.e. an “I gotta call the cops” problem”) or if they were gonna be a SOLVEABLE problem (i.e. an “’I gotta call my manager in the middle of the night’” problem.) Well, with that statement they already made a determination about me, and they proceeded to escalate.

The two men immediately yelled out “Oh! This Uncle Tom is gonna do what the white people say! C’mon (and he used the word you’re thinking of here) get with the program!!!”

Now, a person like me, who does what I do, and who grew up the way that I grew up, has heard this term before. But, my internal response was to flash like a fire. And once the inferno began raging inside me, the adrenaline started, my pupils dilated and I was ready to fight. And the two men and both the women, sensed it. One of the men immediately started jumping up and down with his hands in the pockets of his hoodie, staring me dead in the face, egging me on.

This was my fifth mistake.

And we hadn’t even approached addressing the topic at hand.

Everything began to slow down, from my point of view. And everything became sharply clear.

I visualized my options, and in turn, the outcomes of exercising those options:

Fight and lose my job, possibly my freedom, and probably my life, because I had no idea if the men (or the women) were armed.

Or, call the cops or my manager and “firefight” until they showed up.

Or, get them out of the building as quickly as possible and not worry about pride, or personal offence.

I had those three clear thoughts, and even as I laid out the options for myself in my head, I chose the last one.  At the time I was working at that place, the third option was our way of “de-escalating” a customer.  But you weren’t supposed to tell the customer you were doing that. I threw that policy out the window when I turned to them, raised my voice, and said “I guess I’ll have to get you a refund on your tickets and your food then. And I’ll get you passes for the next time you come back.”

My heart is pounding, the inside of my head feels like jelly, and as I made my sixth mistake, I looked at their faces, reading their nonverbal expressions—a mixture of surprise, disappointment, elation, disgust, pride, victory—and I didn’t have a clear thought other than “Turn to the computer and start the process.

As I did, these words—still two octaves too high in the open lobby, began to ring out from the group:

“Oh yeah, YOU go and get us our refund!”

“You ain’t nothing! Who do YOU work for around here!”

“Damn right we’ll get our money back. This entire place is RACIST!”

“You gotta CALL somebody to get me my money!?”

And on.

And on.

In reality the entire refund process took about three minutes. Find the file on the computer, print the documents, walk to the printer, put the documents on the counter in front of the desk, have them sign, collect the passes, give them the passes, watch them walk out of the building.

It felt like it took ten years.

As they walked out, triumphantly waving their free passes and their refunds above their heads, they cried out “We’re NEVER coming back here! We’re going to Regal!!!”

I didn’t care. I sat back down in the chair in my office, and as the adrenaline left my body, and the incident passed, I trembled and shook. I was relieved t have them out of the building, with no police, or managerial, involvement.

Thinking back on the incident, there were many things at play in the confrontation: perceptions, emotions, ideas, thoughts, motivations, goals, history, biological responses, and even cultural issues. All of which, if handled differently would have put me (and them) in a different place.

As it is, our lives are only entwined in the story that I tell. A story they have probably long forgotten. And a story, now here for you all to read.

The Bible tells us that knowing the right thing to do –in thought, in word, and in deed—and then refusing to do it (or choosing to do something different) is sin.  The secular world tells us that sin is just a poor environment, the result of bad parenting, or just a set of bad decisions.

But at every step in making my six biggest mistakes, I was triggered in a conflict cycle toward another reaction, by other people who were in relationship with me, and also triggered in that moment, by my responses and reactions.  The conflict cycle is not sinful. The conflict cycle is not just a product of environments. The conflict cycle—just like our lives—is a complex, gossamer – like, combination of ourselves, our world, and our choices.

And breaking all of that apart, and learning from it, so we don’t repeat the mistakes in our lives, is a critical process for us to grow and change.

[Strategy] My 6 Biggest Mistakes…pt. 1

The first mistake I made was not verifying the claim.

The second mistake I made was walking in the room.

The third mistake I made was confronting inappropriately.

When the customer came and got me, I was busy doing another task and I was switching back and forth. With the small gaps in between the thoughts and the switching. The customer who came and got me said “There’s been disruptions all evening from these people and you and your staff haven’t done anything about it.”

And then, the customer stared at me.

Nonverbal communication drove a lot of this, and with one look, I was prodded into action. But, instead of verifying the claim of disruption (my first mistake) I instead reacted and sprang into action. I hustled down the long hall, into the dark room, where the light from the images flickered across the faces of the people staring in rapt attention. I walked down a poorly lit aisle (my second mistake) and knelt down in front of the people in the general area where I had been informed that the disturbance was occurring.

I said something to the effect of “I’ve gotten a report about a disturbance in this area. I’d like you to quiet down so that other people can enjoy the show.”

The third mistake was confronting inappropriately.

Then, I turned around and walked out of the dark room, into the light of the hallway. I proceeded to head back to the office, feeling a vague sense of self-satisfaction. I tasked switched back to the work I had been doing before the customer initially approached me, and continued to believe that all was well.

I often tell groups that, even though I am a trainer and conflict engagement professional, and even though I can tell you what the right response is, and even though I can tell you how you should respond and manage other people antiseptically, I’m often confronted with the results of my own poor choices in my own life.

At the time that I made these three mistakes in a row, I had the same education and knowledge level that I do now. At the time that I made these three mistakes in a row, I knew much of the literature on response, reaction, and how to navigate both.

At the time that I made these three mistakes, I knew the path, but I was far away from getting committed to implementing walking the path, 1% better every day.

And then, to compound my problems, I went ahead and made three more mistakes.

[Opinion] The Candy Coated World 2

Advice based on principles is the chocolate candy missing underneath much of the candy coated knowledge and information on the Internet these days.

Principles aren’t really that compelling though, and talking about them leaves no room for entertainment, spectacle, or fame.

Positions are much more compelling, because they can shift with mores, styles, and trends. Talking about positions is entertaining, but not really relevant.

I keep pressing this point in various ways: Wisdom cannot be distilled into just one blog post, one podcast interview, one live streaming video feed, one impermanent interaction at a time. Wisdom comes from developing relationships, but it seems that our human tendency on the Internet to favor our dessert over our vegetables has begun to creep into our real-time, real-world interactions.

Advice based in principles, relationships, lived experiences, as well as theories and ideas, leads to innovation, progress, and development. But it can all seem like gossamer when your relationships with other people don’t work out like they seem to via your social media platform of choice.

There are ways to accumulate this advice: solitude, mindfulness, focus, respect, deep thinking, writing, and listening without arguing in your head with the person speaking are the tools (in the Frederick Winslow Taylor mode, they are the 22lb shovel) you can use to acquire wisdom.

Style over substance used to be a negative, but that era is long since passed. And in our rush to get to the next innovative hill, we forget the time tested tools, insights, and advice that come from hard-won wisdom.

And we risk being increasingly unfulfilled by a candy-coated shell.

[Strategy] Simple But Not Easy

Conflict represents the apex of our emotional tower as a human species: Conflict, no matter how rationally we attempt to approach it, write about it or think about, is a deeply emotional process.

Too many of us are unwilling to engage in the emotional hard work that we don’t get immediate gratification for, that will lead to ascending higher in the emotional tower, rather than descending lower.

Conflict as a process represents the best hope that humanity has of getting us through the hardest questions that seem to bedevil us constantly. Those questions are made of words; and those words that surround conflict—both stated and unstated–have meaning, and language is triggered by emotions.

But approaching conflict from relationship, rather than from religion, and engaging in emotional labor with a desire to grapple with being consciously uncomfortable, and through having our blind spots examined by others, is the only way to de-escalate the most consistently bedeviling public–and private–questions of our day.

Courage.

Labor.

Engagement.

Relationship.

Conscious discomfort.

Educating, advocating, and encouraging people to ascend the emotional tower of conflict with these rhetorical, and actual, tools is not sexy, not flashy, and not celebrated often enough.

It’s simple. But it’s not easy.

[Advice] Relational Resonance

Resonance is a term from physics that describes what happens when an object’s natural vibration frequency responds to an external stimulus of the same frequency.

Resonance occurs in nature when an object vibrates without you even touching it. Resonance happens when people fall in love with each other; and, resonance shifts when people fall into conflict with each other.

The reason that litigation is such a poor method for resolving disputes is because most—if not all—disagreements, fights, and “differences of opinion,” are about relationships, built on reciprocation and maintained through common resonance. When the frequency gets disrupted by an external change, the resonance goes away and the struggle to resolution really a hero’s journey back to resonance. Litigation changes the frequency of the relationship between individuals and between individuals and organizations, from one of commonality and vibrating at the same frequency, to one of vibrating at different frequencies.

What does all of this have to do with the conflict resolution professional?

  1. Creating stories that resonate with audiences and clients who are seeking to get back into relationships with resonance, is one of the most important skills that peace builders must grasp in order to design, market, and promote products, services, and processes that will get them revenues.
  2. Creating resonances is about getting to the same frequency—at the same time—that audiences and clients are no matter when and where they are in conflict. Thus, peace builders must consider whether advocating for early-stage interventions (rather that primarily trying to promote late-stage resolution products and services) is a better way to proceed long-term.
  3. Creating the conditions for conflict resolution professionals and audiences to speak the same language—and thus be on the same frequency, will require conflict resolution professionals at all levels to abandon the higher language of “conflict as an opportunity for growth” and move toward the audience language of “conflict as a roadblock to be avoided, accommodated, or attacked.”

The first two are easy. The last is hard.

Peace building is about doing the hard things, doing them well, and doing them consistently—and in a committed way—and building a field and a brand over time that audiences will flock too, that clients will gladly pay money for, and that peace builders can hand down to the next generation of professionals.

Relational resonance must move from the table between clients and the peace builder to the platforms between peace builders and the world.
